These Terms of Use ("Terms") govern your use of our website located at https://frankli.in and/or the Frankli mobile application (collectively, the "Platform") made available by COLAB SERVICES ("we", "us", and "our"), a proprietorship business owned and operated by Bajrang Singh Shekhawat, having its principal place of business at Plot No. 23 Sudhamapuri 1st, Behind Jodla Power House, Sikar Road, Harmada, Near Bharat Petroleum Petrol Pump, Jaipur, Rajasthan – 302013, India. The terms "you" and "your" refer to the user of the Platform.
These Terms are to be read with the Frankli Content and Community Guidelines and Frankli Privacy Policy. If you do not agree with the terms and conditions of these Terms, please do not use this Platform.
Our Services (as we have described below in detail) and these Terms are compliant with the Indian Penal Code, 1860, and the Information Technology Act, 2000, including all amendments made to it and rules framed under it. When you create an account on our Platform or use our Platform or any of our Services, you accept and agree to these Terms. However, please note that we do not represent that we are compliant with the laws of any country apart from India. If you wish to use our Services, please ensure that you are permitted to do so in your jurisdiction.
You and we are required to follow certain rules while you use our Platform. We have listed these rules in this document. Please read these Terms and all other hyperlinks mentioned here carefully. By using our Platform, you agree to these Terms. Also, if you are using these services outside India, please comply with your local laws.
Changes to Terms and Services
Our Platform is dynamic and may change rapidly. As such, COLAB SERVICES may change the services provided through the Frankli platform at its discretion. We may temporarily or permanently stop providing certain Services or features to users, either generally or specifically.
We may remove or add functionalities to the Frankli Platform and its Services without prior notice. However, if we make a change that requires your consent, we will ensure that such consent is obtained before the change takes effect. Please visit this page regularly to stay informed about the latest updates and developments related to Frankli.
You may review this page periodically to see any changes that we may make, and any services that we may add or modify from time to time.
Who May Use Our Services
The Frankli Platform helps users connect with new people based on their preferred language and interests, allowing them to discover friends and build new connections. Users may connect with multiple individuals and share personalized experiences through the services offered on the Platform ("Service/Services").
You may use our Services only if you are capable of forming a legally binding agreement with COLAB SERVICES and are legally permitted to use the Services. If you are accepting these Terms on behalf of a company or any other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms, and in such cases the terms "you" and "your" will refer to that company or legal entity.
Please ensure that you are legally allowed to use our Services under applicable laws before accessing or using the Frankli Platform.
How to Use Our Services
We have developed a unique platform. The Frankli Platform is designed to help users connect and communicate with new people through chat, audio calls, video calls, and other interactive features. We strive to provide personalized experiences and content that users may enjoy while using the Platform. We may also allow users to download certain content available on the Platform and share their Frankli experience across social media platforms.
To use our Services, you must register on the Frankli Platform by entering your phone number and verifying it through the One-Time Password (OTP) sent by us via SMS to your phone number. When you register using the Frankli mobile application, you may also be asked to grant certain permissions to the application, including access to your device's phone book, SMS inbox, mobile gallery, device storage, and camera. Such permissions are requested only to enable and improve the functionality of the Platform. We do not access or read information stored on your mobile device or computer without your permission.
In order to provide Services to you, we may need access to certain features of your mobile device.
Privacy Policy
To effectively provide and introduce any new Services to you, we collect certain information such as your phone number, name, gender, and other basic profile details when you register on the Frankli Platform. We may also request and store additional information from time to time in order to improve our Services. Such information may be stored securely on cloud servers including Amazon Web Services ("AWS") and Google Cloud Platform servers, and may therefore also be subject to the privacy policies of these cloud service providers.
The Frankli Privacy Policy explains how COLAB SERVICES collects, uses, shares, and stores the information collected from users. The Frankli Privacy Policy also explains your rights under applicable laws and how you may control or manage the data you provide to us.
We have described how we store and use this information in the Frankli Privacy Policy.
As stated in the Privacy Policy, we may also use certain third-party services, integrations, or API services on the Frankli Platform. The use of such third-party services or embeds may be governed by the respective policies of those third parties. By using such services or API integrations through the Frankli Platform, you agree to be bound by the applicable terms and policies of those third-party service providers.
Your Commitments
Providing a safe and secure service for a diverse community requires that everyone does their part. In return for our commitment to provide our Services through the Frankli Platform, COLAB SERVICES requires users to follow certain commitments. You will solely bear the costs and consequences of any actions taken by you on the Frankli Platform, including any violation of these Terms. By using our Services, you agree to the following commitments.
a. No Impersonation or False Information to be Provided
While you are not required to use your real name on the Frankli Platform, you must provide your correct phone number and gender to access and use the Services. You will not falsely represent yourself as another person or claim to represent another individual or entity while using the Platform. If you are operating a parody or satire account for comedic purposes, you must clearly mention this in your Frankli profile or bio.
b. Device Security
We have implemented reasonable measures to maintain the security of the Frankli Platform. However, no digital platform can be completely immune to hacking attempts or virus attacks. You must ensure that your mobile device and computer have appropriate antivirus and anti-malware protection installed. You must not allow another person to use your registered phone number to access the Platform, and you must not create multiple accounts linked to the same phone number. You are responsible for all activities and content posted through the account associated with your phone number.
While we take reasonable steps to secure the Platform, users should also ensure that their mobile devices and computers are not misused, compromised, or tampered with in any way.
c. Content Removal and Termination
Your use of the Frankli Platform is governed by the Frankli Content and Community Guidelines. If any user reports your content and it is found to violate the Frankli Content and Community Guidelines, we may remove such content from the Platform. If repeated violations or multiple reports are received against your account, we may suspend or permanently terminate your account and restrict you from registering again on the Platform.

We reserve the right to remove any content shared on the Frankli Platform if such content violates the Frankli Content and Community Guidelines or applicable laws.
d. Platform Not to be Used for Anything Unlawful or Illegal
The Frankli Platform is designed to support diverse languages, cultures, and social interactions. However, you must not use the Platform to share any content that is obscene, pornographic, harmful to minors, discriminatory, hateful, abusive, violent, or otherwise illegal under the laws of India. Content that promotes hate speech, harassment, or illegal activities is strictly prohibited. We reserve the right to remove such content.

In addition, we may share user information with appropriate law enforcement authorities if we believe in good faith that such disclosure is necessary to comply with legal obligations, government requests, or to protect the rights, property, safety, or security of COLAB SERVICES, its users, or the public. This may also include preventing fraud, security threats, or technical misuse of the Platform. However, COLAB SERVICES cannot be held responsible for the actions of third-party users or any consequences arising from interactions between users on the Platform.
The Frankli Platform is created to provide meaningful and positive social experiences. Users must not share any content that violates laws or harms the well-being of individuals or communities.
e. Content Rights and Liabilities
We believe in freedom of expression and allow users to share photographs, images, videos, audio, messages, status updates, and other content on the Frankli Platform. We do not claim ownership over the content you create and share. The ownership and rights in such content remain with you. However, you must not upload or share content that violates the intellectual property rights of COLAB SERVICES or any third party.
If such violations occur, the content may be removed from the Platform in accordance with the Frankli Content and Community Guidelines. If you use any content developed or owned by COLAB SERVICES, the intellectual property rights for that content will remain with COLAB SERVICES.
By posting or uploading content on the Frankli Platform, you grant COLAB SERVICES a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, store, use, distribute, run, copy, publicly display, translate, and create derivative works of such content in accordance with your privacy settings and the functionality of the Platform.
You may delete your content or account at any time. However, some of your content may remain visible if it has been shared with other users. Additionally, we may retain certain data for a limited period in accordance with our data retention policies, particularly if you delete your account and later request its restoration.
You remain solely responsible for the content you share and your activities on the Platform. COLAB SERVICES does not endorse or take responsibility for any content shared by users. The presence of the Frankli name, logo, or trademarks on user content does not imply endorsement or sponsorship. We are also not responsible for any transactions or agreements made between users or between users and advertisers on the Platform.
You retain ownership of the content you share, but by posting on the Platform you grant COLAB SERVICES a perpetual, royalty-free license to use and display such content as necessary to operate and improve the Services.
f. Intermediary Status and No Liability
COLAB SERVICES operates the Frankli Platform as an intermediary as defined under the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. These Terms are published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which require publishing rules, regulations, privacy policies, and terms for accessing and using the Platform.
Our role is limited to providing a platform where users can create, upload, share, and display content. We do not control the actions or behavior of users on the Platform and therefore cannot be held responsible for the consequences of user actions, whether online or offline.
We are not responsible for services, features, or content provided by third parties, even if such services are accessible through the Frankli Platform. Our responsibility for activities on the Platform is limited to what is required under applicable laws of India.
To the maximum extent permitted by law, COLAB SERVICES will not be liable for any loss of profits, revenue, data, information, or for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including situations where content, information, or user accounts are removed.
As an intermediary, we expect all users to comply with the Frankli Content and Community Guidelines.
g. You Will Not Attempt to Disrupt or Jeopardize Frankli Services
The Frankli Platform is designed as a community-driven platform. You agree not to interfere with or misuse non-public areas of the Platform, our Services, or our technical systems. You must not introduce trojans, viruses, malicious code, bots, or attempt to scrape or collect user information from the Platform without authorization.
You must not probe, scan, or test the vulnerability of our systems or bypass any security or authentication measures implemented by COLAB SERVICES. If you attempt to tamper with the technical design or infrastructure of the Frankli Platform, your account may be terminated and you may be permanently banned from using the Services.
We may also report such actions to the appropriate law enforcement authorities and pursue legal action where necessary.
You must not hack into the Platform or introduce malicious software. If such actions are detected, we may remove you from the Platform and report the matter to the relevant legal authorities.
Compliance Requirements
Relevant news and current affairs publishers may be required to provide details of their Frankli user accounts to the Ministry of Information and Broadcasting or other relevant government authorities as per applicable laws and regulations.
Permissions You Give to Us
By accepting these Terms, you grant COLAB SERVICES certain permissions that enable us to provide and improve the Frankli Platform and Services.
a. Permission to Share Your Profile Information with Third Parties
While the Frankli Platform is freely accessible to users, we may need to generate revenue to continue providing our Services. For this purpose, we may share certain information that we collect, including but not limited to your username, profile picture, gender, and usage or engagement patterns on the Platform, in order to display advertisements or sponsored content.
You acknowledge that COLAB SERVICES will not be liable to provide any revenue share to users based on advertisements or sponsored content displayed on the Platform. We do not endorse or guarantee the authenticity, quality, or reliability of any products or services advertised through the Platform. The presence of advertisements or promotional content does not constitute an endorsement by us.
If we intend to share any sensitive personal information as defined under applicable laws, we will obtain your consent before doing so.
b. Automatic Downloads and Updates
We continuously update and improve the Frankli Platform and the Services offered. In order to use the Platform effectively, you may need to download the Frankli mobile application to your device and install updates from time to time.
Software and applications are regularly updated to improve functionality, security, and performance. You may therefore be required to install the latest version of the Frankli mobile application on your device whenever such updates are made available.
c. Permission to Use Cookies
We may use cookies, pixel tags, web beacons, mobile device identifiers, and similar technologies to collect and store information about how you use the Frankli Platform and related services.
These technologies help us understand user behavior, improve our services, and deliver relevant content and advertisements. Most websites and online platforms use cookies to store and log usage information in the user's web browser.
d. Data Retention
COLAB SERVICES may retain certain information related to your use of the Frankli Platform in accordance with applicable laws and our data retention policies. For more details about how we collect, process, store, and use your information, please refer to the Frankli Privacy Policy.
By using the Frankli Platform, you grant us the right to process, store, and retain information related to you that is collected or provided by you in accordance with our Privacy Policy.
Our Agreement and What Happens if We Disagree
a. Who Has Rights Under These Terms
The rights and obligations under these Terms apply only to you and cannot be assigned to any third party without the prior consent of COLAB SERVICES. However, COLAB SERVICES reserves the right to transfer or assign its rights and obligations under these Terms to another entity if required. This may occur, for example, in the event of a merger, acquisition, restructuring, or transfer of business operations.
b. How Will We Handle Disputes
In all cases, you agree that these Terms shall be governed by the laws of India. Any disputes arising out of or relating to the use of the Frankli Platform or these Terms shall be subject to the exclusive jurisdiction of the courts located in Jaipur, Rajasthan, India.
Grievance Redressal Mechanism
As part of our commitment to the privacy and safety of our users, COLAB SERVICES works with relevant authorities where required to help keep users safe on the Frankli Platform. We have established a grievance redressal mechanism to address concerns or complaints raised by users regarding their experience on Frankli.
Various mechanisms for grievance redressal are provided below.
Users can report profiles or content that violate the Frankli Content and Community Guidelines. Reports can be submitted through the Frankli mobile application during a call, through call history after a call has ended, or through other in-app reporting tools where available. Users can select the appropriate reason for the complaint and submit the report. The status of complaints may be visible within the application where such functionality is provided.
If a complaint has been made against you or content uploaded by you, you may be able to view the relevant details in the applicable section of the application and submit an appeal where permitted.
You may also raise issues through the Help and Support section available within the Frankli Platform.
Users may alternatively send an email to support@frankli.in with their concern or complaint. After submission, a ticket or acknowledgment may be generated and appropriate action will be taken in accordance with platform policies and applicable laws.

Limitation of Liability
COLAB SERVICES does not assume any liability for any loss or damage arising directly or indirectly due to inaccuracies, incompleteness of information, or any breach of warranty caused by the actions of users on the Frankli Platform.
The Platform and Services are provided on an "as is" and "as available" basis without any representations or warranties, express or implied, unless otherwise specified in writing. We do not guarantee the quality, uninterrupted availability, security, or error-free functioning of the Platform or Services, nor do we guarantee compatibility with all devices or the correction of all technical issues.
Under no circumstances shall COLAB SERVICES or its affiliates, partners, service providers, employees, agents, or representatives be liable for any special, incidental, punitive, direct, indirect, or consequential damages arising from the use of the Platform or Services, or resulting from the actions of another user on the Platform.
If any limitation of liability contained in these Terms is found to be invalid under applicable law and COLAB SERVICES becomes liable for damages, such liability shall not exceed the amount paid by the user, if any, for the use of the Platform or Services during the one month period preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless COLAB SERVICES and its affiliates, partners, employees, agents, and representatives from and against any claims, proceedings, losses, damages, liabilities, costs, demands, or expenses, including reasonable legal fees, arising out of or relating to: (i) your access to or use of the Frankli Platform or Services; (ii) any breach by you of your obligations under these Terms; (iii) your violation of the rights of any third party, including intellectual property or privacy rights; (iv) any violation of applicable laws or contractual obligations by you; (v) your negligence, misconduct, or misuse of the Platform. These obligations will survive termination of your account or these Terms.
Unsolicited Material
We welcome feedback, suggestions, and ideas from users. However, any feedback or suggestions submitted to COLAB SERVICES may be used by us without restriction and without any obligation to compensate you. We are also not obligated to treat such submissions as confidential.
General
If any provision of these Terms is held to be unenforceable or invalid, the remaining provisions will continue to remain in full force and effect.
Any amendment or waiver of these Terms must be made in writing and approved by COLAB SERVICES.
If we fail to enforce any provision of these Terms or fail to take action against violations, including reporting unlawful activities or suspending user accounts, such failure shall not be considered a waiver of our rights.
COLAB SERVICES reserves all rights not expressly granted to users under these Terms.
